A Property Rental Agreement is a written contract between the owner of the premises and a tenant that will lease or rent the property.
It is always advisable to have a Property Rental Agreement documented in writing and signed by both parties. That way, all provisions are clear and will help to avoid potential problems. In general the agreement will set forth the essential terms of the rental, including the length of the term, the amount of rent due, and when it is expected to be paid. It will also define for the renter any rules that must be adhered to, and what amenities are included with the rental. Should a problem ever occur, having a written record of your rental agreement will be useful between the parties, as well as an extremely important tool should the matter ever go to court.
Just some of the helpful provisions are:
- Reservation Information: This document has a provision that will indicate if a reservation in being held in a renter's name and will include the applicable credit card information.
- Security Damage Agreement: This provision is particularly important in rentals, as disagreements often arise over alleged damages and how the security deposit will be charged, and/or returned.
- Check-In/Check-Out Procedure: This helpful provision outlines a procedure for checking in and checking out of the rental;
- Use and Enjoyment of the Premises: By law, a tenant is entitled to a certain degree of use and enjoyment of the property. This provision will set out what the premises has to offer and assures the renter that they will meet their expectations in terms of enjoyment. This provision sets out specific matter such as smoking, alcohol consumption, and whether pets are allowed.
- Hold Harmless Provision: A hold harmless provision is an important element to be included. This will ensure that the renters will protect the owners from any liability that may result during the rental term such as from an accident or illness.
